By signing below, I acknowledge and agree to the following:
I understand that participation in swimming activities, pool use, parties, memberships, and related activities at ISR of Western Penn LLC (“ISR”) involves inherent risks, including but not limited to:
Slips, trips, and falls;
Drowning or near-drowning;
Injuries resulting from rough play or horseplay;
Contact with other participants or equipment;
Exposure to waterborne illnesses or communicable diseases;
Physical exertion or overexertion;
Accidents occurring in or around the pool or facility;
Negligent acts by participants or others;
Property damage or loss; and
Serious bodily injury, disability, paralysis, or death.
I voluntarily assume all risks associated with participation and use of ISR facilities by myself, my child(ren), and my guests.
I release and hold harmless ISR of Western Penn LLC, its owners, employees, instructors, contractors, and agents from any and all claims, liabilities, injuries, damages, losses, or expenses arising from participation in activities or use of the facility, including claims arising from ordinary negligence.
I agree to follow all posted rules and staff instructions. ISR reserves the right to remove any participant or guest for unsafe, disruptive, or inappropriate behavior without refund.
Memberships may not be used for birthday parties, group events, organized gatherings, commercial activities, lessons, team activities, or any other party or event-related purpose unless separately approved in writing by ISR and any required party or facility rental fees are paid.
ISR reserves the right to suspend or terminate memberships without refund for misuse of membership privileges or unauthorized party or group use.
No alcohol, illegal drugs, marijuana, vaping, smoking, or intoxication of any kind are permitted on or during use of the ISR facility at any time. ISR reserves the right to immediately remove any participant or guest violating this policy without refund.
ISR reserves the right to charge cleaning, repair, or replacement fees for excessive messes, bodily fluids, food or beverage spills, smoke or marijuana odors, vandalism, damage to pool equipment, play structures, walls, furniture, fixtures, or other facility property.
Minimum charges may include:
Excessive cleaning fee: $150.00
Smoke, marijuana, or illicit odor remediation fee: $250.00
Minor property damage repair fee: starting at $100.00
Major property damage: actual repair or replacement cost
ISR reserves the right to pursue additional legal remedies for damages exceeding these amounts.
In the event of an emergency, I authorize ISR staff to obtain medical treatment for myself or my child(ren), and I accept responsibility for all related medical expenses.
I understand that ISR may photograph or record activities for promotional purposes unless I provide written notice otherwise.
This Agreement shall be governed by the laws of the Commonwealth of Pennsylvania.
This Waiver and Release of Liability shall remain valid for one (1) calendar year, January through December, from the date signed and must be completed again annually for continued participation, memberships, parties, or use of ISR facilities.
